On August 1st, 2023, former President Donald Trump was charged with-
Conspiracy to Defraud the U.S. - 18 U.S.C. 371: This charge accuses Trump of conspiring to disrupt the function of the Federal Government by stating false information knowingly, organizing fraudulent electors to cast votes in seven states, using the DOJ to voice election concerns based on knowingly false information, and attempting to use the Vice President’s position to halt election proceedings - using an authoritative position to pressure the Vice President into doing so.
(Two Counts) Conspiracy to Obstruct an Official Proceeding - 18 U.S.C. 1512: This charge is in reference to two separate attempts to undermine the certification of electoral voting.
Conspiracy Against Rights - 18 U.S.C. 241: This accuses Trump (and co-conspirators) of using positions of authority to intimidate and threaten individuals & officials who are free to exercise rights provided by the Constitution - including the right to vote.
Trump’s legal team defended him in recent hearings, stating that Trump was utilizing his First Amendment right and that the information he provided was stated knowingly in good faith. Separately, Trump faces additional charges from the district attorney in Fulton County, Georgia, and 34 charges brought by local prosecutors in New York in a business-records case (stemming from hush payments to Stormy Daniels). As for how the Grand Jury charges will unfold, Trump may seek a delay in proceedings until after the 2024 election.
